Transition Options

Which existing generators can transition to the FIT and microFIT programs?

Projects of any renewable technology that have a capacity of 500 kW or less and were purchased or were in service by 11:59 p.m. on October 1, 2009 will be eligible to transition to the FIT and microFIT Programs. They will be deemed to have met the domestic content requirements.

Generators who have not been operating under an OPA contract will receive a 20-year FIT or microFIT contract. Generators who have been operating under a RESOP contract will obtain a contract representing the balance of the 20-year FIT or microFIT contract.

How do RESOP contract projects 500 kW or less transition?

All RESOP projects 500 kW or less may transition to the FIT Program as follows:

• For projects larger than 10 kW and less than or equal to 500 kW, the RESOP contract will be amended to include FIT pricing.
• RESOP projects 10 kW or less that purchased generating equipment by October 1, 2009 will terminate the RESOP contract and convert to the microFIT program.
• Projects must reach commercial operation by December 31, 2010.
• Domestic content requirements will be deemed to have been met.

For further details, please visit the Transition Options section of this website.

How do existing non-RESOP contract projects 500 kW or less transition?

Net-metered projects, merchant generators or projects not yet in service where the generating equipment was purchased by October 1, 2009 may apply to the FIT or microFIT Programs.

• Projects larger than 10 kW and less than or equal to 500 kW in service by October 1, 2009 can apply to the FIT Program and declare commercial operation at the same time. No fee or securities will be required.
• Projects larger than 10 kW and less than or equal to 500 kW that have purchased the generating equipment by October 1, 2009 can apply to the FIT Program.
• Projects 10 kW or less that purchased generating equipment by October 1, 2009 will apply to the microFIT Program.
• Projects must reach commercial operation by December 31, 2010.
• Domestic content requirements will be deemed to have been met.

For further details, please visit the Transition Options section of this website.

Are any existing projects under 500 kW excluded from the transition options?

The transition options do not apply to waterpower projects covered by the May 7, 2009 direction to the OPA (re: negotiating new contracts with hydro-electric generation facilities).

What are the timelines and documentation for transitioning to the FIT and microFIT programs?

The timelines and documentation are summarized below. Please refer to the Transition Options document for further details on the timelines and documentation that apply to your project.

MICRO PROJECTS (10 kW or less)

RESOP

  1. RESOP projects 10 kW or less (micro) where the equipment was purchased by October 1, 2009* should sign and submit a RESOP to microFIT Transition Agreement to the OPA by 11:59 p.m. on November 30, 2009.
  2. RESOP projects 10 kW or less (micro) where the equipment was not purchased by October 1, 2009 must sign and submit a RESOP Mutual Termination Agreement to the OPA by 11:59 p.m. on November 30, 2009. They will not be deemed to meet domestic content requirements.

NON-RESOP

  1. Existing non-RESOP projects 10 kW or less (micro) where the equipment was purchased by October 1, 2009 should apply to the microFIT program by 11:59 p.m. on November 30, 2009.
  2. Existing non-RESOP projects 10 kW or less (micro) where the equipment was not purchased by October 1, 2009 should apply to the microFIT program. They will not be deemed to meet domestic content requirements.

FIT PROJECTS (over 10 kW to 500 kW)

RESOP

  1. RESOP projects greater than 10 kW and less than or equal to 500 kW where the equipment was purchased by October 1, 2009* should notify the OPA of their request to amend their RESOP contract by 11:59 p.m. on November 30, 2009.
  2. RESOP projects greater than 10 kW and less than or equal to 500 kW where the equipment was not purchased by October 1, 2009 must sign and submit a RESOP Mutual Termination Agreement to the OPA by 11:59 p.m. on November 30, 2009. They will not be deemed to meet domestic content requirements.

NON-RESOP

  1. Existing non-RESOP projects greater than 10 kW and less than or equal to 500 kW where the project had reached commercial operation by October 1, 2009 must apply to the FIT Program by December 31, 2010.
  2. Existing non-RESOP projects greater than 10 kW and less than or equal to 500 kW where the equipment was purchased by October 1, 2009* but the project had not reached commercial operation by that date should apply to the FIT Program by November 30, 2009.
  3. Existing non-RESOP projects greater than 10 kW and less than or equal to 500 kW where the equipment was not purchased by October 1, 2009 should apply to the FIT Program. They will not be deemed to meet domestic content requirements.

*This also includes projects that have reached commercial operation by October 1, 2009.
