Under the proposed Feed-In Tariff rules the OPA has not adequately responded to concerns raised by the farming community on the impact of theses rules to farm operations. Specifically our farm has spent considerable resources in conducting CIA, CCE and CCRA work with Hydro One Networks in order to develop our Biogas facilities. We are being asked to rescind all of this work in order to apply for a FIT contract but are not being adequately protected for the cost of previous work and loss of our legacy position, all of which we have undertaken in good faith. Accordingly, we cannot accept this condition and must ask that we be given priority access to the distribution grid and issuance of a FIT contract at program launch.

The OPA has also indicated that it wishes to receive 80% of any future profits related to associated products or services resulting from the initial Biogas project. We vehemently object to this intrusion of our business development and wish to point out that any income streams relating to this project have been fully anticipated at its conception and have been included in the financial viability assessment.
