Title:  Transition from RESOP to Home ReFIT (<10kW)

Document Text:  There are many questions being asked on the Q and A about micro solar <10kW. The main issue is: who is eligible for the new Home REFIT program. Everyone wants the $0.80/kWh. I submit that the following applicants should qualify:

1. Any new applicant starting from the announcement date, March 12, 2009.
2. Any current RESOP contract that is incremental should have all of its future stages applicable.
3. Any current RESOP contract holder that has not been paid for a single kWh .
4. Any residential, commercial or industrial building or property that puts the solar system either on their roof or on their property.

Arguments for each point:
1. The FIT and Home ReFIT should start March 12, 2009 and be applicable for every applicant between that date and when the new contract details are finalized (ie. August 2009). The potential consequence of not making this retroactive is that current project are not stalled for 4 months to wait for the outcome of the details, and new projects can begin right away. The point here is that we are trying to stimulate the Green Economy right away.
2. The OPA has already stated that incremental projects will have access to the new rates. They will have to be metered separately (a pain to the Generator) but the earlier phases do not apply because they are already receiving money under the RESOP.
3. This one is the toughest. There are numerous contract holders in Ontario that are early adopters who have been trying to bring their projects online for over a year. The contract holders have faced administrative red tape, punitive administrative fees, feet dragging, lack of understanding regarding metering and road blocks at every turn. Some have turned to net metering to "wait it out", others agreed to higher administration fees. For example, at one time the monthly administration fees to run a 1 kW system varied from $40 per month down to $0 per month depending on what LDC you asked. To illustrate this point, $40 per month equals $9 600 over twenty years. A RESOP contract holder who has received no financial benefit from the contract and experienced numerous form applications, been required to hound LDC's to facilitate their requests, deserves to be grandfathered into the Home REFIT programs. They should be treated as heroes and ushered right to the front of the line! The current statements by the OPA are that even these contracts must be fulfilled and if they are cancelled or defaulted then the site or project will not be eligible to receive a Home ReFIT contract. This is punitive and unnecessary in this case.
4. This one I believe will be resolved quickly and simply. The LDC can facilitate systems that are 10 kW or less because they have very little impact when they are associated with a user of electricity. Merely clarifying the wording will allow a pole mounted system right next to a house, or a solar panel covered parking space for employees to meet the requirements because it will be metered and included on the bill (possibly a cheque) of the already existing account.

To summarize: If you have received money from the RESOP then you are stuck with it. Otherwise, welcome to the FIT program. This would allow a distinction as to who is applicable and smooth the transition from the RESOP to the Home REFIT program. The sooner these issues are clarified, the faster the industry will grow and I believe that is the goal of the Green Energy Act and the OPA.
