Response Date

For projects that rely on transmission or distribution expansions, the OPA will issue a response to a notice to proceed request the later of:

  • 15 months after the FIT contract was awarded
  • 20 business days after the request is made.

This timing allows the OPA to assess whether the required transmission or distribution expansions will be completed on time. If there is a serious risk of delays in the required transmission or distribution expansions, the OPA either will delay issuing the notice to proceed or may have to terminate the contract.

If your project is a capacity allocation-exempt project and there is no risk that it will be delayed due to transmission expansions, the OPA will issue a notice to proceed following completion of the prerequisites.
