Your application time-stamp will be awarded at the end of the program launch based on the following approach:
|
Has the applicant selected commercial operation date acceleration days on the application form?
|
Following program launch, applications will be prioritized according to the date and time the application is submitted, as described in the FIT Rules.
Projects that are not offered a FIT contract at the end of the launch period will not be held to their reduced commercial operation date (COD) deadline. These projects will proceed to the economic connection test, FIT production line or FIT reserve as necessary to wait for the grid upgrades required to connect their projects. Once these project proponents are offered a contract, they will be subject to the commercial operation date deadlines set out in the FIT contract.
Liquidated Damages
If you are awarded a contract after submitting acceleration days, you will be subject to liquidated damages if you fail to achieve commercial operation within the time specified in your application.
All other contractual provisions, such as force majeure and event of default for being 18 months late in achieving commercial operation (six months for solar PV), remain in place.
Example:
A five-megawatt (MW) solar PV project might submit 30 COD acceleration days. This means that the new milestone date for commercial operation is the end of month 35, instead of the end of month 36.
If the project is not able to meet the deadline and achieves commercial operation after 37 months (i.e., 60 days late), the applicant would be subject to liquidated damages of:
In addition, the contract term (payment period) is shortened by 60 days.
