Is there any zoning requirements on the properties where we wish to build a large scale solar/wind project? (ex: can we build a 10 MW solar project on a lot zoned commercial or vacant residential?)
If a property is not zoned properly according to the first question above, does the GEA include any easements for developers? If not, I suppose it means we will have to go through a public process with the municipality, correct? thank you |
| Answer: | The GEA (Section K) has removed the requirement to re-zone property to allow for renewable generation. This was included in order to relieve the burden of going through the municipal/public re-zoning process. The primary requirement dealing with municipalities is that you will have to obtain a building permit. Please note however that there may be restrictions on building solar farms on agricultural lands (final decision pending). |
