| Question: | Where a "Legacy Project" proponent has recieved a completed CIA from the LDC, but DOES NOT HAVE access to the property named in the CIA, would they be eligible to apply for a FIT Contract, or under the draft rules #3.2.a.ii, would their application be denied. Assuming the application would be denied, and with all else being equal, would the next "Legacy Project" in the queue that HAS access to the property have the opportunity to apply? |
| Answer: | If the proponent is not able to demonstrate site access, the application to the FIT Program will be denied, regardless of CIA status. If the `next' Legacy Project in the queue is able to demonstrate site access and meets the other application requirements, this project would be eligible to apply. |
