Evidence of Land Access Rights

Either title to or rights of access to the location of a project, sufficient to build, operate and maintain the project, enforceable from the time of application and for the term of the FIT Contract. The contractual rights may include a lease or option to lease, license, letter of intent, memorandum of understanding or other grant conditional only on the applicant entering into the FIT Contract.

The evidence must show that the applicant has either title or rights of access to the site, sufficient to build, operate and maintain the project for the application period and duration of the FIT Contract.  

On land types with other ownership/access-right agreement structures, other evidence may be provided, including:

  • Federal Crown lands: priority permit
  • First Nation lands: copy of document evidencing site access rights
  • Provincial Crown lands: Applicant of Record status or Crown Land Site Report and grid cell numbers. Information on the Crown Land Site Report can be found here (French version here) 
  • School rooftop: site licence

Applicants submitting an application for a waterpower project must also submit a Waterpower Declaration, in the prescribed form.
