The restrictions/caps outlined for CLI Classes 1, 2 and 3 soils do not apply to lands zoned for non-agricultural purposes as of October 1, 2009. To determine whether this circumstance applies to your project, please refer to the zoning by-law(s) that cover the area proposed for your project. Zoning by-laws are publicly available documents from municipalities, often through their websites.
If, when reviewing the zoning by-laws, you determine that the land you propose for your project has been zoned as of October 1, 2009 for non-agricultural purposes, you are not required to submit the information and maps regarding soil classifications described above.
However, you are required to submit a copy of the zoning schedule (map) with an outline of the site proposed for your project. You must also provide written confirmation from the municipality's chief planning official or clerk certifying that the land proposed for your project was entirely zoned for non-agricultural purposes as of October 1, 2009.
